KULLANIM KOŞULLARI
Değerli Ziyaretçimiz, Aşağıdaki, FDSocial uygulaması ile uygulamaya üye olan kişiler arasındaki üyelik sözleşme metnidir. Üye olmadan önce lütfen bu sözleşmeyi dikkatle okuyunuz ve sözleşmenin içerdiği tüm maddeleri onaylamadan siteye üyeliğinizi tamamlamayınız. Yeni üyelik esnasında, bu metni okuduğunuzu söyleyen bir kutucukla karşılaşacaksınız; bu kutucuğu işaretlemeniz, aşağıdaki maddelerin tamamını kabul ettiğiniz anlamına gelecektir.
İşbu sözleşme, FDSocial uygulaması ile üye olan kişi (“Üye”) arasında düzenlenmiş, elektronik ortamda üye tarafından onaylanması anında akdedilmiş ve karşılıklı olarak yürürlülüğe girmiştir.
Uygulama: www.fadiyari.net adresinde yayın yapan internet sitesi ve bu adresteki Android uygulaması ile, bu adresteki IOS uygulaması.
Üye: FDSocial uygulaması uygulamasında üyelik formunu doldurmuş, “Üyelik Sözleşmesi’ni okudum, kabul ediyorum.” ifadesinin başındaki kutucuğu işaretlemiş ve “Üye Ol” butonuna basarak üye olma sürecini tamamlamış kişi.
Standart Üyelik: Üyenin FDSocial uygulamasında kullanılacak olan profil alanındaki bilgileri (genel bilgiler, profil fotoğrafı, ilişki durumu vb.) girerek oluşturduğu ve profile bakma ve FDSocial yönetimi tarafından uygulama trafiğinin üye ve uygulama açısından en elverişli kullanımını sağlamak, uygulamanın kalitesi ve üyelerin huzurunu en yüksek seviyede tutmak ve uygulamayı suistimal etmek isteyen üyeleri elimine etmek amacıyla belirlenmiş olan ve yine işbu belirtilen kriterler doğrultusunda cinsiyet grubu içerisinde muayyen ve makul farklılık gösteren günlük mesaj hakkı içeren, sitede üyelik için gerekli işlemlerin gerçekleştirilmesini takiben aktif hale gelen üyelik şeklidir.
Premium Üyelik: Standart üyelikte belirtilen ve günlük belirli sınırlara tabi olan uygulamaları (mesajlasma vb.) sınırsız olarak kullanma hakkı veren, uygulama tarafından sitede belirtilen bedeller üzerinden ücrete tabi üyelik şekli. Bu üyelik paketleri üyenin kullandığı cihaza göre Apple veya Google şirketlerinin uygulama içi satın alma yöntemleri ile satın alınabilir.
Kredi: Üyelerin uygulamada belirlenen ücretler karşılığında alabileceği ve satın alan üyeye bazı ayrıcalıklardan (profile bakanları görebilme, özel mesajlarda ses kaydı gönderebilme vb.) yararlanma imkanı veren bir nevi uygulama içi para.
Üye profili: Uygulama içinde üyenin kendisinin verdiği bilgilerle oluşturulan, Üyelik Bilgileri, Genel Bilgiler, yaş, cinsiyet gibi bilgiler ve üyenin kendisi tarafından eklenen fotoğraflardan oluşan, diğer üyeler tarafından görüntülenebilen Üyeye özel interaktif alan.
Bu sözleşmenin konusu, uygulama, indirme ve satın alma platformları üzerinden alınan FDSocial uygulamaları üzerinden sunulan hizmetlerin, bu hizmetlerden yararlanma şartlarının ve tarafların hak ve yükümlülüklerinin tespitidir. Üye, bu sözleşme hükümlerini kabul etmekle, uygulama içerisinde yer alan kullanıma, üyeliğe ve hizmetlere ilişkin FDSocial tarafından açıklanan her türlü beyanı da kabul etmiş olmaktadır. Üye bahsi geçen beyanlarda belirtilen her türlü hususa uygun olarak davranacağını kabul, beyan ve taahhüt eder.
Üye, üyeliği süresince, uygulamanın hizmetlerinden faydalanırken ve uygulamanın hizmetlerle ilgili herhangi bir işlemi yerine getirirken bu sözleşme içerisinde yer alan tüm şartlara, uygulamanın ilgili yerlerinde belirtilen kurallara ve yürürlükteki tüm mevzuata uygun hareket edeceğini, bu sözleşme ile belirlenen tüm şart ve kuralları anladığını ve onayladığını kabul, beyan ve taahhüt eder.
Uygulamaya ve uygulamada sunulan servislere üye olabilmek için 18 yaşını doldurmuş bir gerçek kişi olmak ve uygulamada bulunan Üye Formunu doldurmak gerekmektedir. FDSocial, yapacağı değerlendirme sonucu başvuru sahibini üyelik haklarından faydalandırabileceği gibi, hiçbir gerekçe göstermeksizin başvuruyu reddetme hakkına da sahiptir. Bu Üye Sözleşmesi’ni onaylamak ile Üye, 18 yaşından büyük olduğunu taahhüt etmektedir. Bu şartı taşımayan kişilerin üyelik kayıt işlemlerini tamamlamış olmaları ve bu sözleşmeyi onaylamaları, üyelik sonucunu doğurmayacaktır. 18 yaşını doldurmamış veya verdiği bilgilerde tutarsızlık olduğu tespit edilen Üyenin üyeliği iptal edilir. Üyenin vermiş olduğu yanlış beyandan dolayı uygulamanın herhangi bir sorumluluğu bulunmamaktadır.
Üyenin standart üyelik kapsamında hazırlamış olduğu profilinin FDSocial tarafından kabul edilmesi aşağıdaki şartlara bağlıdır:
* Profiller e-posta adresi, web adresi, telefon numarası, sosyal medya hesabı gibi (doğrudan ya da dolaylı olarak) kişisel bilgi içeremez.
* Profillerde kullanıcının kendini anlattığı alanlar, ayrıntılı, açık ve gerçeğe uygun olmalıdır.
* Profillerde kullanıcının kendini anlattığı alanlarda, herhangi bir biçimde hakaret içeren, seksist ya da ırkçı ifadeler kullanılamaz.
* Profillerde, gönderilerde ve yorumlarda herhangi bir siyasi görüşün, dinin vb. propagandası yapılamaz.
* Profiller suç teşkil edecek, yasal açıdan takip gerektirecek, yasalara aykırı bilgi içeremez.
* Uygulamaya üye olurken üyenin verdiği e-posta adresinin üyeye ait ve aktif bir e-posta adresi olması zorunludur. Üyelikle ilgili tüm yazışmalarda uygulamaya üye olurken verilen e-posta adresi esas alınır ve bu adres kullanılır. FDSocial verilen e-postanın doğru olduğunu kabul eder ve buna göre davranır. Yanlış ve yalan beyan edilen e-postalardan oluşabilecek hatalardan ve zararlardan uygulama sorumlu değildir.
* Üye, uygulamanın yürürlükteki emredici mevzuat hükümleri gereğince resmi makamlara açıklama yapmakla yükümlü olduğu durumlar içersinde, resmi makamlarca usulü dairesinde bu bilgilerin talep edilmesi halinde üyelere ait gizli/özel/ticari bilgileri resmi makamlara açıklamaya yetkili olacağını ve bu sebeple uygulamadan her ne nam altında olursa olsun tazminat talep edilemeyeceğini kabul ve taahhüt eder.
* Üyelerin, site aracılığıyla uygulama tarafından sunulan hizmetlerden yararlanabilmek amacıyla kullandıkları sisteme erişim araçlarının (kullanıcı adı, şifre v.b) güvenliği, saklanması, üçüncü kişilerin bilgisinden uzak tutulması, kullanılması durumlarıyla ilgili hususlar tamamen üyelerin sorumluluğundadır. Üyeye ait kullanıcı adı ve şifre ile gerçekleştirilen her işlem bizzat Üye tarafından gerçekleşmiş sayılacaktır. Üyelerin, sisteme giriş araçlarının güvenliği, saklanması, üçüncü kişilerin bilgisinden uzak tutulması, kullanılması gibi hususlardaki tüm ihmal ve kusurlarından dolayı üyelerin ve/ veya üçüncü kişilerin uğradığı veya uğrayabileceği zararlardan uygulamanın doğrudan veya dolaylı herhangi bir sorumluluğu yoktur.
* Üyenin uygulamaya üye olurken seçmiş olduğu ya da sonradan değiştirmiş olduğu mention ismi üyeye özeldir ve başka bir üye tarafından kullanılamaz. Üyenin kullanmak istediği bu ismin başka bir üye tarafından kullanılması durumunda üyeden başka bir isim seçmesi istenecektir. Üye, mention ismini ve şifresini korumak ile yükümlüdür. Bu yükümlülüğe uyulmaması durumunda uygulama hiçbir sorumluluk kabul etmemektedir.
* Üyeler uygulamadaki ilgili bölümlere ve üye profillerine kendileri tarafından sağlanan bilgilerin ve içeriklerin doğru ve hukuka uygun olduğunu kabul ve taahhüt etmektedirler. FDSocial, üyeler tarafından siteye iletilen veya üye profillerinin oluşturulmasında ve değiştirilmesinde kendileri tarafından yüklenen, değiştirilen ve sağlanan bilgilerin ve içeriklerin doğruluğunu araştırma; bu bilgi ve içeriklerin güvenli, doğru, bu sözleşmenin hükümlerine ve hukuka uygun olduğunu taahhüt ve garanti etmekle yükümlü ve sorumlu olmadığı gibi söz konusu bilgi ve içeriklerin yanlış veya hatalı olmasından ve/veya bu içerikler aracılığıyla diğer internet sitelerine yapılan yönlendirmelerden dolayı ortaya çıkacak hiçbir maddi-manevi zarardan da sorumlu tutulamaz.
* Üyeler, FDSocial yönetiminin yazılı onayı olmadan bu sözleşmeyi veya bu sözleşmenin kapsamındaki hak ve yükümlülüklerini, üye profillerini, üye bilgilerini kısmen veya tamamen herhangi bir üçüncü kişiye devredemez; üyelik üyenin kendisinden başka kişilerin kullanımına açılamaz. Bu tür devirler veya yetkisiz kullanımlar sonucu üçüncü kişilerin uğradıkları veya uğrayabilecekleri zararlardan dolayı FDSocial doğrudan ve/veya dolaylı olarak hiçbir şekilde sorumlu tutulamaz. Üyeliğini başkasına kullandırttığı veya devrettiği tespit edilen üyenin üyeliği iptal edilir.
* Üyelerin, kendi aralarında uygulama aracılığıyla yaptıkları özel mesajlaşmalar da dahil olmak üzere sitede yaptıkları her işlem ve eylemdeki hukuki ve cezai sorumluluk kendilerine aittir. Üyelerin birbirlerine gönderdiği mesajlar ile ilgili olarak FDSocial hiçbir şekilde sorumluluk kabul etmemektedir. Bu sebeple FDSocial uygulamasının uğrayabileceği her türlü zarara karşılık üyeye rücu hakkı saklıdır.
* FDSocial mesaj merkezinde bulunan toplam mesaj sayısı, paylaşım sayısı ve yorum sayısı, belirli limitleri aşıyor ise, bu içerikler en eski tarihli olandan başlayarak silinebilir. Sisteme bir ay boyunca hiç giriş yapmayan üyelerin ise mesajlarının tamamı silinebilir. Üye bu hususu peşinen kabul eder.
* Üye, başka bir üyenin veya üçüncü bir kişinin gizlilik hakkını ya da yayın haklarını çiğneyen, telif hakları, ticari marka hakları veya başka mülkiyet hakları tarafından korunan ya da bu tarif edilen sınıflara giren malzemelerden uyarlanan hiçbir bilgi, yazılım ya da başka bir malzemeyi, sahibinden ya da haklarını elinde tutan kişiden izin almaksızın, postalayamaz ya da iletemez. Böyle bir durumda FDSocial uygulamasının hiçbir sorumluluğu bulunmamakla beraber, uygulamanın uğrayabileceği her türlü zarara karşılık üyeye rücu hakkı saklıdır.
* Üye, suç teşkil edecek, yasal açıdan takip gerektirecek; yerel ve ulusal yasalara ya da uluslararası anlaşmalara ters düşecek bir durum yaratan ya da böyle durumları teşvik eden, hiçbir tür yasadışı, tehditkar, rahatsız edici, hakaret, küfür içeren, küçük düşürücü, kaba, pornografik, rahatsız edici ya da ahlaka aykırı bilgi postalayamaz, iletemez veya mesaj atamaz. Özel mesajlar otomatik programlar ile taranabilir veya mesaj gönderilen Üyelerin şikayeti üzerine incelenebilir. Bu otomatik tarama sonucunda veya şikayet sonrasında yapılan incelemede gerekli görüldüğü takdirde üyenin profili yayından kaldırılabilir, mesajlaşma hakkı kısıtlanabilir, bütünüyle engellenebilir veya üyeliği tamamen iptal edilebilir. Böyle bir durumda uygulamanın hiçbir sorumluluğu bulunmamakla beraber, uygulamanın uğrayabileceği her türlü zarara karşılık üyeye rücu hakkı saklıdır.
* Üye diğer üyelere, reklam ya da ticari amaçlar içeren veya diğer üyeleri bir başka internet sitesine yönlendiren hiçbir bilgi, yazılım ya da malzeme içeren mesajlar gönderemez, postalayamaz veya iletemez; diğer üyelerden herhangi bir ürün satın almak ya da onlara ürün satmak gibi bir talepte ve reklam faaliyetinde bulunamaz; bu amaçla üyelere yönelik “e-posta zincirleri” kuramaz; “junk e-posta” gönderemez. Bu tür mesajlar üyenin mesajlaşma hakkı kısıtlanabilir ya da üyeliği iptal edilebilir. Bu kapsamda bir yetki dışı kullanım durumunun tespit edilmesi durumunda FDSocial uygulaması hukuki yollara başvurma hakkını saklı tutar. Her üye, uygulamada bulunan resimlerin, metinlerin, görsel ve işitsel imgelerin, video kliplerin, dosyaların, veritabanlarının, katalogların ve listelerin tüm haklarının saklı olduğunu kabul ve beyan eder. Üye hakları saklı bulunan bu materyalleri çoğaltmayacağını, kopyalamayacağını, dağıtmayacağını, işlemeyeceğini, gerek bu eylemleri ile gerekse de başka yollarla FDSocial ile doğrudan ve/veya dolaylı olarak rekabete girmeyeceğini kabul ve taahhüt etmektedir. Üyelerin bu Sözleşme hükümlerine ve hukuka aykırı olarak gerçekleştirdikleri uygulama üzerindeki faaliyetleri nedeniyle üçüncü kişilerin uğradıkları veya uğrayabilecekleri zararlardan dolayı FDSocial doğrudan ve/veya dolaylı olarak hiçbir şekilde sorumlu tutulamaz.
* Üyelerin sözleşmedeki kurallara uymadığı FDSocial yönetimi tarafından tespit edildiğinde söz konusu üyenin hesabı kapatılabilir. Hesabın kapatılması durumunda krediler için yapılan ödemeler iade edilmez, üye iade talebinde bulunamaz.
FDSocial uygulamasına kayıtlı bulunan tüm kullanıcılar, yukarıda yazılı bütün kuralları ve politikaları eksiksiz olarak okuduğunu, anladığını ve kabul ettiğini taahhüt eder. FDSocial, yukarıda belirtilen kurallarda değişiklik yapma hakkını saklı tutar. FDSocial uygulamasına kayıt olmanız durumunda yukarıda belirtilen kuralları tamamen okumuş ve kabul etmiş olursunuz.
Bu sözleşmede zaman zaman değişiklik ve güncellemeler yapılabileceğinden dolayı belirli aralıklarla sözleşmeyi kontrol etmek üyenin sorumluluğundadır. Herhangi bir güncelleme yapıldığında uygulamanın bunu üyelere bildirme zorunluluğu yoktur.
FDSocial, uygulamada sunulan hizmetleri ve içerikleri her zaman değiştirebilme, üyelerin sisteme yükledikleri ve bu Sözleşmede belirtilen şartlara uymayan bilgileri, içerikleri ve üye profillerini, üyeler de dahil olmak üzere üçüncü kişilerin erişimine kapatabilme ve silme hakkını saklı tutmaktadır. FDSocial bu hakkını hiçbir bildirimde bulunmadan ve süre vermeden kullanabilir. Üyeler, FDSocial uygulamasının talep ettiği değişiklik ve/veya düzeltmeleri mümkün olan en kısa sürede yerine getirmek zorundadırlar. FDSocial tarafından talep edilen değişiklik ve/veya düzeltme istekleri gerekli görüldüğü takdirde bizzat FDSocial tarafından yapabilir. FDSocial tarafından talep edilen değişiklik ve/veya düzeltme taleplerinin, üyeler tarafından zamanında yerine getirilmemesi sebebiyle doğan veya doğabilecek zararlar, hukuki ve cezai sorumluluklar tamamen üyelerin kendilerine aittir. Uygulama üzerindeki yönlendirmeler (link, banner) vasıtasıyla erişilen portallar, web siteleri, dosyalar ve içerikler, bu linkler vasıtasıyla erişilen portallar veya web sitelerinden sunulan hizmetler veya ürünler veya bunların içeriği hakkında FDSocial uygulamasının herhangi bir sorumluluğu yoktur. FDSocial, uygulamanın işleyişine, genel kurallarına, genel ahlak kurallarına aykırı ve tarafından kabul edilmesi mümkün olmayan mesajları, içerikleri istediği zaman ve şekilde erişimden kaldırabilir. FDSocial bu mesaj ve içeriği giren üyenin üyeliğine herhangi bir ihbar yapmadan son verebilir. Üye uygulamaya yüklediği ahlaka ve hukuka aykırı içerik sebebiyle uygulamanın maruz kalacağı her türlü zararı tazmin etmekle yükümlüdür. Uygulamadan kaynaklanan ya da kaynaklanmayan herhangi bir hata, ihmal, kesinti, silinme, bozulma, iletimde gecikme veya iletişim ağı başarısızlığı gibi teknik sorunlardan dolayı uygulama ve üyeler ile üyelerin kendi arasındaki iletişiminde kesintiler olabilir. Bu kesintilerden dolayı yaşanan iletişim ve uygulamaya ulaşmaya ilişkin kesintilerde üyenin yaşayacağı sorunlardan FDSocial sorumlu tutulamaz. FDSocial, iTunes Store ve Google Play gibi uygulama indirme ve satın alma platformları üzerinden; bu platformlar tarafından ücretlendirmesi yapılan Premium Üyelik ve uygulamada üyelere tanınan ayrıcalıklardan faydalanma imkanı sağlayan “kredi” satışlarında, üyenin premium üyelik paketini veya kredi alımını iptal etmek istediği durumlarda, yapılacak iade işleminin uygulama ile hiçbir bağlantısı bulunmayıp, Uygulama, iade işlemi konusunda yaşanan aksaklıklar ve sorunlar konusunda sorumlu tutulamaz. Aynı şekilde üçüncü kişilerin, bu hizmet ve uygulamalar ile bağlantılı olarak ve/veya bu hizmetler ve uygulamalardan kaynaklanan hiçbir maddi, manevi, dolaylı veya direkt zararından FDSocial sorumlu değildir. Üyenin, Premium üyelik veya kredi alım işlemini iptal ederken gerçekleşen veyahut gecikmeler nedeniyle vücut bulan zararları için, muhattabı alışveriş işlemini gerçekleştirdiği ve yukarıda belirtilen platformlardır. Bu hususlar konusunda doğacak uyuşmazlıklar konusunda FDSocial hiçbir şekilde sorumlu tutulamayacaktır. Uygulamada yayınlanan ve Üye profillerinde yer alan her türlü görüntü, yazı, fotoğraf ve diğer materyal FDSocial yönetiminin izni olmadan diğer internet sitelerinde ve gazete, televizyon, radyo, dergi gibi konvansiyonel mecralarda yayınlanamaz. Uygulamada yer alan tüm içerik, Fikir ve Sanat Eserleri Kanunu’nun dördüncü maddesinin yedinci bendi olan, “Belli bir maksada göre ve hususi bir plan dahilinde verilerin ve materyallerin seçilip derlenmesi sonucu ortaya çıkan ve bir araç ile okunabilir veya diğer biçimdeki veri tabanları” ile koruma altında olduğu gibi eser niteliğindeki içerik ayrıca hukuki korumaya tabidir.
Bu sözleşme üyenin üyeliği iptal edilinceye veya üye üyelikten istifa edinceye kadar yürürlükte kalacak ve taraflar arası hüküm ve sonuçlarını doğurmaya devam edecektir. Premium üyeliğin sona ermesi ile üyelerin standart üyelikleri devam edecektir. FDSocial, üyelerin bu sözleşmede belirtilen hükümleri ve site içinde yer alan kullanıma, üyeliğe ve hizmetlere ilişkin benzeri kuralları ihlal etmeleri durumunda sözleşmeyi tek taraflı olarak feshedebilecek ve üyeler fesih sebebiyle uygulamanın uğradığı tüm zararları tazmin etmekle yükümlü olacaktır.
